Individual/Commercial Breach of Contract Disputes

LA LAW FIRM represents individuals and corporations for the purpose of enforcing their agreements with others, and the benefits due them under these agreements.  Breach of contract occurs when a party of an agreement deviates from the agreed upon terms or when one party prevents the other party from performing their part of a contract.

In order for the breach of contract to lead to a lawsuit, the damage must be material.  However, the advice of an attorney in any breach of contract situation can prove to be valuable.  That's where we come in - our attorneys can help negotiate a settlement in the case of a breach of contract.  Filing a lawsuit is an option in a breach of contract, though alternatives for dispute resolution include mediation and arbitration.  LA LAW FIRM can represent you in any of these legal situations.

Your rights in a breach of contract will depend greatly on the terms of the contract.  A breach of contract may result in the pursuit of:

  • Compensatory damages - monetary reimbursement for your losses
  • Specific performance - a court order required performance of the agreed upon action
  • Rescission - both parties are relieved from their responsibilities as the contract is canceled
  • Reformation - changing or rewriting a contract to address issues or mistakes when one party has been deceived or mislead
  • Punitive damages - money awarded to punish the offending party/defendant (punitive damages are rare in breach of contract cases)

You are wise to consult an attorney before entering into a contract.  If you find yourself in a breach of contract situation, the LA LAW FIRM is experienced in legally enforcing binding agreements.

Commercial Debt Collection

When the time comes LA LAW FIRM to begin using legal tools to collect outstanding debts owed to your business, we can help.  We have extensive experience working with our business clients to help them secure debts owed to them.

Sometimes just letting a debtor know we have become involved is enough to compel payment.

If court action is required, we will take the case to Small Claims Court or if the owed amount is higher than the Small claims limit, we will file your claim in the applicable State Court.

LA LAW FIRM can assist in the collection of any type and amount of debt, including judgments, promissory notes and accounts receivable.  The group will also liquidate security interests on equipment or vehicle leases through repossession of the asset and pursuit of a deficiency judgment for the balance.

Our attorneys make every effort to secure payment before suit is necessary.  If suit is necessary, our experienced attorneys guide  the matter through the litigation process to entry of judgment.

Once judgment is entered, the firm uses various tools to locate and retrain assets and income that can be applied to the satisfaction of the judgment.  The firm utilizes an independent asset search company to locate debtor's bank accounts, enabling restraining notices to be forward to those which "freeze" the funds on deposit so they can be garnished and applied towards the judgment.

If initial attempts at locating assets do not result in satisfying of the judgment, the firm will use various other means including income executions, information subpoena and examinations of debtors, in order to compel payment and satisfaction of the judgment.
